1. Acceptance of terms

By using MySmartFunding's website and submitting an application, you agree to these Terms of Service. If you do not agree, please do not use our services.

2. Description of service

MySmartFunding operates an online marketplace that connects applicants with third-party lenders. MySmartFunding is not a lender, does not make credit decisions, and does not guarantee approval, specific rates, or specific terms. Any loan offer is made and governed entirely by the lender you are matched with.

3. Eligibility

You must be at least 18 years old and a resident of the United States to use this service.

4. Accuracy of information

You agree to provide true, accurate, and complete information in your application. Submitting false information may result in your application being rejected and may violate applicable law.

5. No guarantee of approval

Submitting an application does not guarantee that you will be matched with a lender, receive an offer, or be approved for any loan. Approval, rates, fees, and terms are determined solely by the lender.

6. Credit authorization and communications consent

By submitting the application and checking the applicable consent boxes, you authorize a credit check in accordance with the Fair Credit Reporting Act (FCRA) and, if you opt in, consent to receive marketing communications in accordance with the Telephone Consumer Protection Act (TCPA). You may withdraw marketing consent at any time.

7. Third-party lenders

Any loan agreement you enter into is directly between you and the lender. That lender's own terms, privacy policy, and disclosures govern the loan. MySmartFunding is not a party to that agreement and is not responsible for a lender's actions, terms, or conduct.

8. Prohibited uses

Submitting an application on behalf of someone else without authorization
Providing false or misleading information
Attempting to interfere with or disrupt the site or its underlying systems

9. Disclaimer of warranties

The service is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, MySmartFunding is not liable for any indirect, incidental, or consequential damages arising from your use of the service or any loan obtained through a matched lender.

11. Governing law

These Terms are governed by the laws of WY, without regard to conflict-of-law principles.

12. Changes to these terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the revised Terms.
